Icebreaker: Terms of Service

1. The Service

Icebreaker is a Progressive Web App (PWA) designed to facilitate in-person social discovery.

• What it is: A tool to provide context and consent-based "approach" requests for people in the same physical location.
• What it is NOT: Icebreaker is not a messaging app, a dating app, or a social media platform. It does not provide chat interfaces or long-distance digital interaction.

2. User Eligibility & Conduct

• Age Requirement: You must be at least 18 years of age to use this Service.
• In-Person Intent: You agree to use the app solely to facilitate real-world, face-to-face conversations.
• Prohibited Behavior: Any attempt to use profile fields, interest tags, or contact sharing to:
  • Bypass the "No Messaging" rule (e.g., posting external chat handles to harass users).
  • Distribute spam or commercial links.
  • Engage in non-consensual persistence after an "Approach Request" is declined.
• Account Termination: Dreamsmyth LLC reserves the right to terminate access immediately for any conduct that violates these terms or the "Social Confidence" mission.

3. Safety & Assumption of Risk

PLEASE READ THIS SECTION CAREFULLY. Icebreaker facilitates meetings between strangers in physical spaces.

• No Background Checks: Dreamsmyth LLC does not conduct criminal background checks or identity verification on its users.
• Personal Responsibility: You acknowledge that meeting strangers in person carries inherent risks. You agree to take all necessary precautions (e.g., meeting in public, informing others of your location).
• Limitation of Liability: By using Icebreaker, you expressly assume all risks associated with such interactions. To the maximum extent permitted by Pennsylvania law, Dreamsmyth LLC and its members shall not be liable for any physical, emotional, or financial harm resulting from your interactions with other users.

4. Geolocation & Data Collection

• Real-Time Tracking: To function, Icebreaker requires access to your device's GPS data. By clicking "Join Event," you consent to this collection.
• Privacy Modes:
  • Incognito Mode: Hides your profile from others while allowing you to browse.
  • Wallflower Mode: Marks your status as "Quiet."
  • Note: Even in these modes, the app may ping your location to maintain event "room" integrity and aggregate "Vibe" density data.
• Background Tracking: Background location collection is strictly limited to "Paid Tier" users who have explicitly enabled the "Always-On" feature.

5. Intellectual Property

All software code, modular JS architecture, "Vibe Search" algorithms, and the "Icebreaker First" business strategy are the exclusive property of Dreamsmyth LLC. You are granted a limited, personal, non-exclusive license to access the PWA for its intended social purpose.

6. Dispute Resolution

Any legal action, suit, or proceeding arising out of or relating to these Terms shall be governed by the laws of the Commonwealth of Pennsylvania and shall be instituted exclusively in the courts of Lehigh County, Pennsylvania.

7. Updates to Terms

As a startup in active development (Phase 2), we may update these terms frequently. Continued use of the PWA after updates constitutes acceptance of the new terms.
